Terms of use

1. INTRODUCTION

This End User License Agreement (“Agreement”) is a legal agreement between you (“User” or “You”) and Ryseup Studios (“Ryseup Studios” or “Licensor”) governing your use of Roboquest (“Game”) on PlayStation. By installing, accessing, or playing the Game, You agree to be bound by the terms of this Agreement.

You must be at least 12 years old to use the Game. If You are between 12 and 18 years old (although this may be different depending on the age of adulthood in your country), please ask your parent or guardian to review and approve these Terms and supervise your use of the Game.

2. GRANT OF LICENSE

Ryseup Studios grants You a limited, non-exclusive, non-transferable, and revocable license to install and use the Game for personal, non-commercial use on PlayStation. You may not sublicense, distribute, or modify the Game without prior written consent from Ryseup Studios.

3. OWNERSHIP AND INTELLECTUAL PROPERTY

All rights, title, and interest in the Game, including but not limited to copyrights, trademarks, and proprietary content, remain the sole property of Ryseup Studios. You agree not to reverse-engineer, decompile, or create derivative works based on the Game.

4. RESTRICTIONS ON USE

You may not:

  • Use the Game for commercial purposes without permission.
  • Modify, hack, or exploit the Game in any way.
  • Violate any applicable laws or regulations while using the Game.
  • Attempt to gain unauthorized access to the Game’s services or data.

5. ONLINE SERVICES AND CODE OF CONDUCT

This Game includes online multiplayer functionality. To ensure a safe and enjoyable environment for all players, You agree to abide by the following Code of Conduct:

5.1 Prohibited Behavior

  • Harassment & Abuse: Do not harass, threaten, or abuse other players. This includes hate speech, discrimination, or any form of cyberbullying.
  • Cheating & Exploits: Do not use cheats, hacks, bots, or other unauthorized third-party software to gain an unfair advantage.
  • Impersonation & Fraud: Do not impersonate other players, Company staff, or attempt to scam other users.
  • Inappropriate Content: Do not share offensive, illegal, or explicit content in any form, including chat messages and usernames.

5.2 Enforcement of Code of Conduct

Violations of the Code of Conduct may result in the following consequences:

  • Warning: A notice of inappropriate behavior with a chance to correct it.
  • Temporary Suspension: A temporary restriction from online features.
  • Permanent Ban: Loss of access to online services or, in severe cases, full access to the Game. Ryseup Studios reserves the right to determine the severity of the violation and apply appropriate measures.

6. USER-GENERATED CONTENT (UGC)

6.1. Creation and Rights

The Game may allow You to create, upload, or share content, including but not limited to text, images, videos, and custom modifications (“User-Generated Content” or “UGC”). By creating or sharing UGC, You grant Ryseup Studios a worldwide, non-exclusive, royalty-free, irrevocable, and transferable license to use, modify, reproduce, distribute, and display your UGC in connection with the Game and its promotion.

We encourage and support fan-created content related to the Game, such as fan art and fan videos. However, such content should not be commercialized in any way.

You are permitted to stream or produce videos of the Game and monetize them through advertising revenue on platforms such as Twitch and YouTube.

6.2. User Responsibilities

You are solely responsible for the content You create and share. Your UGC must comply with these Terms and remain solely your responsibility. In particular, You agree that your UGC will not:

  • Violate any laws or third-party rights, including intellectual property rights.
  • Contain offensive, harmful, or inappropriate material.
  • Be used for commercial advertising without authorization.

6.3. Moderation and Enforcement

Ryseup Studios reserves the right to remove or restrict any UGC that violates this Agreement or is deemed inappropriate at its sole discretion.

7. DATA COLLECTION AND PRIVACY

The Game may collect personal and non-personal data as described in our Privacy Policy. By using the Game, You consent to the collection and processing of your data in accordance with the Privacy Policy.

8. TERMINATION

This Agreement remains in effect until terminated by You or Ryseup Studios. Ryseup Studios reserves the right to terminate your access to the Game at any time if You violate the terms of this Agreement.

9. INDEMNITY

You shall on demand and in full indemnify and hold harmless Ryseup Studios, its affiliates, and their officers, directors, employees, and agents (and keep them indemnified and held harmless) from and against any and all claims, demands, causes of action, suits, judgments, contributions, fines, penalties, losses, damages, liabilities, costs, and expenses, including attorneys’ fees, whatsoever arising out of or in connection with your breach of any obligations, representations, or warranties under this Agreement.

10. DISCLAIMERS. NO WARRANTIES

Except as otherwise set forth in this Agreement, the Game is provided “as is” and on an “as available” basis, without warranty or condition of any kind, either express or implied. Ryseup Studios specifically (but without limitation) disclaims all warranties of any kind, whether statutory, express, implied, or otherwise, relating to the Game, including but not limited to (i) any implied warranties of merchantability, fitness for a particular purpose, title, quiet enjoyment, or non-infringement; and (ii) any warranties arising out of the course of dealing, usage, or trade. Ryseup Studios does not warrant that the Game or any part thereof will be uninterrupted, secure, or free of errors, viruses, or other harmful components, and does not warrant that any of the foregoing will be corrected.

You understand and agree that You use the Game at your own discretion and risk, and You will be solely responsible for any damage to your property (including your equipment used in connection with the Game) or loss of data that results from the use of the Game.

Some jurisdictions may prohibit a disclaimer of warranties and You may have other rights that vary from jurisdiction to jurisdiction. Ryseup Studios does not exclude or restrict liability which under applicable local law cannot be excluded or restricted.

11. LIMITATION OF LIABILITY

In no event will Ryseup Studios be liable to You for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses or cost of procuring substitute goods or resources) arising out of or relating to your access to or use of, or your inability to access or use, the Game, whether based on warranty, contract, tort (including negligence), statute, or any other legal theory and whether or not Ryseup Studios has been informed of the possibility of such damage.

You agree that the aggregate liability of Ryseup Studios to You for any and all claims arising out of or relating to the use of or any inability to use the Game under this Agreement, whether in contract, tort, or otherwise, is limited to the amounts You have paid under this Agreement for the Game giving rise to the claim in the 12 months prior to the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. Accordingly, the above limitation may not apply to You.

Each provision of this Agreement that provides for a limitation of liability, disclaimer of warranties, or exclusion of damages is to allocate the risks under this Agreement between You and Ryseup Studios. This allocation is an essential element of the basis of the bargain between the parties. Each of these provisions is severable and independent of all other provisions of this Agreement. The limitations in this section 11 will apply even if any limited remedy fails of its essential purpose.

12. DISPUTES / GOVERNING LAW

Both parties agree to make reasonable and good faith efforts to resolve any dispute informally. Normally, this dispute resolution period shall last 30 days unless exceptional circumstances exist. If necessary, either party has the legal right to commence legal claims against the other. If You bring a legal claim against Ryseup Studios, You should send it to contact@ryseupstudios.com.

You and Ryseup Studios agree that your use of the Game and this Agreement (including any issues arising from it) shall be governed and interpreted in accordance with the laws of France. Any dispute regarding this Agreement shall fall under the jurisdiction of the courts of France. This does not exclude any mandatory applicable rules or remedies available to You under the laws of your country of residence.

13. CHANGES TO THIS AGREEMENT

Ryseup Studios reserves the right to update this Agreement at any time. Continued use of the Game after changes have been made constitutes acceptance of the revised terms.
